01Service provider identification

These terms govern the relationship between each user and {{LEGAL_ENTITY_NAME}}, tax ID {{LEGAL_TAX_ID}}, registered address {{LEGAL_ADDRESS}} and registration details {{LEGAL_REGISTRY}}, operating under the Echoris brand. While those values remain in braces, this document is a draft under professional review and is not production-ready. Contract questions may be sent to support@echorisapp.com.

Echoris provides access, discovery and acquisition services for digital audio tours and tools through which independent creators prepare and publish content. The provider's complete legally required identity and contact information must remain permanently, easily, directly and freely available.

02Purpose and acceptance

When you create an account and tick the acceptance box, you confirm that you could open, read, store and reproduce these terms before continuing. General acceptance does not replace specific consent required for an immediate download, marketing, device permissions, a purchase or creator onboarding.

If you use Echoris on behalf of an organisation, you represent that you may bind it. If you do not understand these terms, lack legal capacity or disagree with them, do not accept them or use private and purchasing features. Merely browsing public pages is not express contractual acceptance.

03Account, access and security

Your account is personal. You must provide accurate information, keep it current and secure the identity-provider credentials you use. You may not transfer an account, impersonate another person, bypass access controls or permit use that compromises purchases, listening rights or functions reserved for guides, reviewers or administrators.

Tell us promptly about unauthorised access. We may request proportionate checks to protect or restore the account. Echoris will not ask for your Google password or full card details. Authentication, sessions, roles and marketplace availability are enforced through technical controls and server-side decisions.

04How the marketplace works

Echoris organises an audio-tour marketplace. Each listing should identify the creator, describe the content, state price, language, duration, format, compatibility and technical measures, and disclose the main ranking parameters and whether reviews are verified where applicable.

Echoris makes and invoices the sale to the tourist under the model described in the pre-contract information, while each creator remains responsible for the authorship and legality of submitted material. Editorial or technical review does not make Echoris the author or guarantee that every cultural, historical or practical statement is error-free.

05Purchase and electronic contracting

Before purchase, we show a summary of the product, total price including applicable taxes, payment method, steps and means to correct errors. The final control clearly indicates that the action entails payment. A confirmation is then sent or made available in a durable medium.

Web payments are processed by authorised providers and Echoris does not store full card details. Availability of Stripe, Apple, Google or another method depends on channel, territory and configuration. A payment authorisation alone does not complete an order if the provider rejects, reverses or fails to confirm it.

06Licence to acquired content

A purchase grants a personal, limited, non-exclusive, non-transferable and non-commercial licence; it does not transfer intellectual property. Unless the listing says otherwise, you may access and listen to the acquired audio tour for your own use on compatible devices and applications linked to the account.

You may not resell, sublicense, distribute, communicate publicly, scrape at scale, create derivative works, remove authorship notices or make content available to others. The absence of DRM does not broaden this licence. Technical copies needed for legitimate downloading or playback remain limited to that purpose.

07Intellectual property and notices

The platform, software, design, brand, original copy and technical elements belong to Echoris or its licensors. Audio tours and creator materials belong to their respective rights holders. No rights are transferred except for the limited use licence expressly described here.

If content infringes copyright, trade marks, image rights or another right, write to support@echorisapp.com identifying the protected work or right, the content or URL, your contact details and a sufficient explanation. Echoris may request more information, temporarily limit access and process the notice under its notice-and-takedown procedure.

08Permitted use and conduct

You must not use the service unlawfully, harass or discriminate, distribute malware, manipulate reviews, falsify purchases, interfere with security, collect others' data without a lawful basis, automate abusive access or publish material that infringes rights, promotes unlawful violence or exposes personal data.

Reviews, profiles and user-generated content are subject to moderation, reporting and blocking mechanisms. Legitimate criticism and good-faith opinions are not removed merely because they are negative. Decisions take account of context, severity, repetition and the rights of affected people.

09Suspension, removal and account deletion

We may restrict content or functions where required by law or because of security risk, fraud, non-payment, serious or repeated breach, or harm to others. Where possible and legally permitted, we explain the essential reason and how to request a review.

You can request account deletion through available controls or at support@echorisapp.com. Deletion does not immediately remove information retained for tax duties, legal claims, fraud prevention or compliance. Licences and access may end when the account is deleted, subject to rights that mandatory law preserves.

10Availability, warranties and liability

We work to keep the service safe and available, but maintenance, network failures, incompatibility, third-party changes and justified removals may occur. Nothing here excludes mandatory legal guarantees or limits liability for fraud, personal injury or any matter that applicable law does not permit us to exclude.

Audio tours provide cultural and informational material. They do not replace official instructions, signage, access rules, emergency warnings or personal safety judgment. Stay aware of your surroundings, comply with local restrictions and do not use a device in a way that creates danger while walking, driving or taking part in an activity.

11Changes to these terms and the service

We may amend these terms for legal, technical or service changes. We publish a date and stable version. If a change materially affects rights or duties, we request fresh acceptance before private features remain available; purely editorial corrections with no material effect do not require reacceptance.

Changes do not retroactively reduce acquired rights where law prohibits that. If you reject a material update, you may stop using the service and request account closure, without affecting duties and claims arising earlier.

12Governing law and disputes

These terms are interpreted under the consumer and electronic-commerce law that applies. For consumers, any reference to {{LEGAL_JURISDICTION}} is without prejudice to mandatory courts and protections at the consumer's residence or other rights that contract cannot exclude.

Before court proceedings, contact support so we can seek a resolution. Public alternative-dispute and consumer-authority mechanisms depend on residence and current law. Echoris does not impose mandatory private arbitration where doing so would conflict with non-waivable consumer rights.

13Contact and notices

Contract communications may be sent to support@echorisapp.com. To investigate an issue, include the account email, order identifier where available, an accurate description and screenshots that do not expose passwords, full card numbers or unnecessary personal information.

Contract notices may appear in the app, be emailed to the account or be published in the legal centre when appropriate. Keep a valid contact channel and retain purchase confirmations, accepted versions and receipts for future reference.
